Nursing home abuse and neglect has become a serious issue as our population ages and more people are requiring those services. In Georgia and around the country, more and more elderly people are less able to take proper care of themselves and their personal affairs.  A family’s decision to put a loved one in an assisted care facility or nursing home is never an easy one, but it is often a necessary choice.  However, in a growing number of cases, the elderly are being abused and neglected physically, emotionally and financially by those who are in charge of their care.  Nursing home abuse and neglect includes the failure to provide basic needs, which can result in problems and injuries including:

  • Dehydration
  • Malnutrition

  • Osteomyelitis
  • Infection
  • Death

Studies show that about half of all nursing home deaths and injuries are due to infection, malnutrition and dehydration caused by neglect.  Other forms of abuse involve physical attacks, assaults, and emotional and financial abuse.  Georgia law provides a Bill of Rights for residents of long-term care facilities.  Georgia Code § 31-8-100 et seq. These resident regulations include:

  • The right to privacy, dignity and respect
  • The right to receive proper care and treatment
  • The right to be free from physical restraints, restrictions on mobility or isolation
  • The right to have at least 12 continuous visiting hours per day
  • The right to know of their medical condition
  • The right to freely communicate, meet and associate with persons of their choice in private rooms
